BAC – Blood Alcohol Content. BAC is the value representing the relationship of milligrams of alcohol in one hundred milliliters of blood. BAC is used as an assessment of intoxication.

Breathalyzer – A breathalyzer evaluates the BAC to prove if suspects in custody have been driving under the influence of alcohol. There are several types of breathalyzers, such as the Intoxylizer and the Intoximeter. All breathalyzers need to be operated by a trained technician.

DUI - Driving Under the Influence. You may be charged with Driving Under the Influence if you are found to be operating a vehicle while having a Blood Alcohol Content (BAC) level above .08. Although DUI’s are a common occurrence in Maryland, they are one of the most serious traffic related matters.

DWI – Driving While Intoxicated. You may be charged with Driving While Intoxicated if you are found to be operating a vehicle while having a BAC of .07 or higher. Although this charge is not as severe as a DUI, the BAC threshold is lower than what is nationally recognized as the point of intoxication, or .08.

Officer’s Certification and Order of Suspension - Police officers will give you this form when you are arrested for a DUI or DWI in Maryland. There is a ten day (10) time limit in which you must present this form to the Office of Administrative Hearings or your license will be suspended forty six (46) days after you were arrested. The structure of your license suspension is dependent on many variables, including previous DUI convictions, the intensity of your BAC value, and whether or not you preformed the breathalyzer test itself.
