Security Clearance: DUI

Many people rely on their security clearance to maintain employment and professional licenses. The process of obtaining security clearance can be grueling, and losing that status based on a Maryland DUI conviction can be devastating.

Every company is different in the way the handle security clearance. Some companies revoke security clearance simply based on a charge or arrest. In these cases, whether a person is convicted or not makes no difference. Others only revoke a clearance if a person is convicted or enters a plea of guilty.

In certain circumstances, even if a person is found guilty or enters a plea of guilt, they still may be able to maintain a clean record with a disposition called Probation Before Judgment (PBJ). This allows the judge to withhold a finding of guilt at sentencing and make the charge eligible for expungment after certain conditions are met. Many employers do not revoke security clearance if a person received a PBJ and the case can be or has already been expunged.
